How Does Local Government Work?

01 What does Law No. 123 regulate?
The Law establishes how local state administrations and local self-government bodies are organized and operate, including their objectives, functions, powers, and relationships.
Article 1 of the Law02 What is local self-government?
It is the independent resolution of local matters by a local community in its own interests, under its own responsibility, and within the limits established by law. It is exercised directly by citizens or through local self-government bodies.
03 Who belongs to the local community?
The local community consists of citizens who permanently reside within the relevant village area. Community members may discuss local issues, submit proposals, and use the forms of participation provided by law.
04 Which local self-government bodies operate in a village area?
The main local self-government bodies in a village area are:
- the representative body — the Village Council;
- the executive body — the Village Government.
The Village Council represents the interests of the local community and adopts decisions, while the Village Government organizes their implementation and carries out the responsibilities established by law.
05 What matters are considered issues of local significance?
The Law defines the main areas of local significance. These include:
- socio-economic development of the territory and the local budget;
- drinking water supply, sewerage, waste collection, and sanitation;
- maintenance of local roads, streets, and public spaces;
- management of municipal property;
- landscaping, public amenities, and infrastructure development;
- other matters related to organizing local services for residents.
06 What matters does the Village Council decide?
At its sessions, the Village Council considers the local budget and its execution report, territorial development programs, the use of municipal property, and other matters assigned by law to its exclusive competence. The Council also operates standing and temporary commissions.
Article 34 of the Law07 What functions do the Village Government and its Head perform?
The Village Government is the executive body of local self-government. Its Head organizes the implementation of laws, lawful acts of state authorities, and decisions of the Village Council, manages the Village Government staff, and ensures execution of the local budget and development programs.
Article 54 of the Law08 How can citizens participate in local decision-making?
Members of the local community may participate in the following ways:
- take part in citizens’ gatherings and meetings;
- express their views at public hearings;
- put forward local initiatives and submit proposals;
- participate in kurultais and public discussions;
- submit written, electronic, or oral appeals to the Village Government or Village Council.
09 Why is a citizens’ gathering or meeting held?
A gathering or meeting is held to jointly discuss matters important to residents of a street, neighborhood, village, or the entire village area. Problems, proposals, and development initiatives are considered, and the results are submitted to the relevant local body.
10 What are public hearings?
Public hearings are open discussions with residents about a draft important decision or an issue of local significance. They may be held on the budget, tariffs, development programs, municipal services, and other matters of public importance. Residents may ask questions and submit proposals and comments.
11 How can a local initiative be submitted?
Community members may initiate a proposal for resolving an issue in the village area or submit a draft local regulatory legal act. The initiative is submitted to the Village Council or Village Government in accordance with the local community charter and applicable legislation.
12 Where can information about the local budget and adopted decisions be obtained?
Information that must be publicly available by law may be requested from the Village Government and the Village Council. Public hearings are held on the draft budget and its execution, while adopted acts and socially significant information are published on the official website, information boards, or through other accessible means.
13 How can an appeal be submitted to the Village Government?
A citizen may submit an appeal in writing, electronically, or orally during a personal reception. The appeal should include the citizen’s full name, contact details, the substance of the issue, and supporting documents, if available. Appeals are considered in accordance with the legislation of the Kyrgyz Republic governing citizens’ appeals.
14 Who is responsible for municipal property and service delivery?
Municipal property is used to meet the needs of the local community. The Village Council and the Village Government exercise property management powers within the competence established by law. Services may be organized by the Village Government, a municipal enterprise, or another organization engaged on lawful grounds.
15 How does a local state administration differ from a Village Government?
A local state administration exercises state executive authority at the district level and coordinates the implementation of state policy and laws. The Village Government is the executive body of local self-government in a village area and addresses matters of the local community. They interact within the powers established by law.
